6. Internet Connection
The Berkshire College London material requires a correctly configured and functional internet data connection, both for the initial Purchase, and for use.
Data charges may be charged to you by your network provider depending on your individual tariff. You are responsible for any such costs.
We are unable to provide any warranties as to the levels of connectivity you will receive via your personal media device. This may depend upon your tariff, your network provider or your corporate policy if you have a work-issued device. We will not accept any responsibility for any connectivity issues you may experience. Please contact your network provider or visit their website if you require assistance configuring a data connection for your phone.
If, however the Berkshire College London website is down and it is believed to be our fault we agree to compensate users how we see fit, this would usually comprise of a credit note being issued for unfinished assessments. Berkshire College London will deal with claims on a case by case basis.
7. Content and Refunds
Once payment is received and products have been delivered to the student’s dashboard, or have been downloaded, refunds are not available. This does not affect your statutory rights.
Goods will only be dispatched to the customer when payment has been made in full and cleared funds and in any variance of this term shall be upon such terms as Berkshire College London dictates.
Access to modules and assessments is limited to 5 (five) years, from the date of enrolment. In exceptional circumstances this may be extended.
Assessments can be re-sit as many times as required within the 5 year period as long payments have been cleared.
Failure to keep up with your monthly payments may incur a £50 admin fee and suspension of your online account.
If students fail to keep up with monthly payments, any free items received will need to return to Berkshire College London.
All Student payments need to be completed before the final awarding body certificate is provided to the student.
Cancellation/Returns Policy:
In accordance with The Consumer Contracts Regulations 2014 you have the right to cancel your order prior to the course materials being received. You can also cancel within a 14-day cooling-off period from when you receive the Course Materials. The option to cancel will not be allowed within the cooling off period if the course has been accessed and work submitted for marking, as at that point Awarding Body fees will be incurred.
All cancellation requests must be made in writing. If you decide to cancel a Course within the 14-day cooling cooling-off period, we will process the refund as soon as possible once materials have been returned and, in any case, within 14-days of the day you have given notice of your cancellation. In this case, we will refund all the course fees that have been paid. It is your responsibility for the cost of returning all course materials, and they must be returned in a resalable condition otherwise a restocking/printing fee will be charged.
Please Note: Refunds or Cancellations cannot be offered outside of the stated refund policy. If you choose not to continue with your course outside of the set cancellation policy then all course fees must still be paid. Outstanding finance payments must be made prior to the issue of certification.
There are no exceptions to the above returns policy as once the period has lapsed, fees such as awarding body registration or tutor fees need to be paid
Non-Payment of Course Fees:
In the event of a payment being cancelled or disputed and returned without consent, we will contact you via the Email Address supplied in your Order and we will then also contact you by Letter and/or Telephone / Text requesting that you rearrange the Payment. If our communications / requests for payment are ignored your account will be passed to a Debt Recovery Agency.
Please Note: In the event of your account being passed for collection, additional admin fees of 15%, for amounts up to £100.00, or 10% for amounts over £100.00 of your total remaining balance will be applied to your account, and will be payable by you. Further County Court costs may be applied if payment is not received which will affect your credit rating in the future. The debt is lodged with all the main credit reference agencies.
For the Avoidance of Any Doubt: If any Termination by You occurs after Dispatch, even prior to the Course being completed or the Services having been provided in full the full Course Price and any Fee’s incurred due to Failed Payment or due to your Account being passed to a Collections Agency will remain due in full and payable by you.
Exceptions to the Cancellation/Returns Policy:
As per the Consumer Contracts Regulations 2014, some items fall outside of the usual returns policy and refunds cannot be offered for items considered digital or downloaded which includes activation codes or exam vouchers. Where refunds are not possible, we will state this in the course start-up information and on the product page of our website. Some online materials will be subject to the usual 14 day cooling off period
Transferring a Course:
A Course transfer may be possible outside of the returns policy term although this would only be possible if selecting a course offered by the same Course Developer or Approved Partner to the course you originally purchased, and whether this is possible will be at the discretion of the course developer. Any such request must be made to us in writing and a restocking fee may be required to cover the cost of the materials.
If it is possible to transfer to another Course, the total fees paid towards the discontinued Course will be offset against the cost of the new Course. A restocking fee may also be required and this cost will be set by the Course Developer or Approved Partner. It may be possible to transfer a course from you to a third party. Any such request must be made to us in writing and whether this is possible will be at the discretion of the Course Developer or Approved Partner.
Course Materials and Time Limits:
We affirm that any course materials will meet a satisfactory level of quality; however, we do not affirm that they will be error free. You will be responsible for inspecting the Course Materials as soon as is reasonably possible following receipt. Furthermore, you will be responsible for informing us about any oversights or errors as soon as possible.
The course support period will be detailed within our sales literature. Further extensions can be purchased on request. Course extensions will only be available if the syllabus that is being studied remains the same. If a syllabus change has occurred then there will most likely be a fee required for supplying new course materials and support.
We or our Approved Partners reserve the right to change Awarding Bodies if policies and procedures change during the period of tuition for your course. You will, however, receive a certificate at the same level and of the same status as the one described when you purchased your course. Some Certification Programs will have closing dates for Exams / Tests which are set externally by the appropriate organisation. We will try to offer only current and relevant Certification but as these exams are external it is your responsibility to research and make sure the exams are still obtainable for the booking of your Exam / Test.
8. Discount Codes
Account discount codes – Discount codes may from time to time be offered to account holders; such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered.
Promotional discount codes – We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.
All Prices and course fees are listed in British Pound Sterling (GBP), and therefore we are not responsible for any exchange rate changes, nor any bank charges that arise from this or any other payments made to BCL.

As Berkshire College London have no control of such sites and resources, you acknowledge and agree that Berkshire College London is not responsible for the availability of such sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources or the policies or such sites and resources.

13. Plagiarism
Academic dishonesty covers any attempt by a student to gain unfair advantage (e.g. extra marks) for her/himself, or for other students, by unauthorised means. Examples of such dishonesty include collusion, deceit, plagiarism and cheating in examinations.
Collusion includes, but not limited to, the conscious collaboration, without official approval, between two or more students, in the preparation and production of work which is then submitted as individual work. In cases where one (or more) student has copied from another, all students involved may be penalised.
Deceit includes misrepresentation or non-disclosure of relevant information, including the failure to disclose any cases of work being submitted for assessment which has been or will be used for other academic purposes.
Plagiarism is the act of using other people’s words, images etc. as if they were your own. In order to make clear to readers the distinction between your words, images etc.
Cheating is defined as any attempt to gain an unfair advantage in an assessment (including examinations), or assisting another student to do so. It includes: copying from other candidates, collusion, impersonation, plagiarism, and unauthorised access to unseen examination papers.

Terms & Conditions of using recurring payments (WorldPay) , if you would like to cancel your reoccurring payments, you will need to emailadmin@berkshireuk.com and let us know you wish to cancel your future payments. Payments are usually taken every month, unless agreed otherwise.
Payments duration’s will vary depending on the course you are enrolled on, e.g if you are enrolled onto a level 7 course (£1400) and your monthly payments are £200, you will be charged £200 for 7 months.
16. Data Protection
Berkshire College London uses personal data of the customer for appropriate purposes and according to statutory regulations. The personal data given (i.e. name, email address, delivery address, bank details) for ordering products is used by Berkshire College London for fulfilment and handling of the contract only.
This data is treated confidentially by Berkshire College London and is not given to any third parties who are not part of the ordering, delivery and payment procedures. The customer shall be entitled to access information on their personal data which Berkshire College London has saved about them, free of charge. 19. Course Accreditation
Courses are accredited by a governing body chosen by Berkshire College London, who assess and reviews all of our content. If there is a change in validating partnership, Berkshire College London will always aim to make sure the new governing body is of the same or higher Standard. No refunds will therefore be issued to students in this Scenario.
All students will be registered with the relevant awarding organisation prior to submission of assignments. (a minimum total payment of £800 in students fees is also required to be fulfilled if paying in instalments)
